UNICEF + Golden Terms of Service and Use
These Terms of Use constitute an agreement between you and UNICEF that governs your use of the UNICEF engagement platform and all associated services, including but not limited to the https://www.unicef.org/thailand/i-am-unicef, and https://dashboard.iam.unicef.or.th/#dashboard (collectively, the “Platform”).
Use of the Platform is also governed by the Terms of Service and Use of UNICEF’s software partner 1, Inc. which are accessible here.
Please read these Terms carefully. You understand and agree that these terms set forth the legally binding terms and conditions for your use of the Site, Dashboards, and Services; and the Site, Dashboards, and Services are made available and provided to you under these Terms. By visiting, using or accessing Site, Dashboards, and Services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, you should leave and discontinue the use of the Site, Dashboards, and Services immediately. If you wish to register as a I Am UNICEF User to make use of the Services reserved for members, you must read these Terms and indicate your acceptance during the registration process. Note, however, that these Terms apply to your access to and use of the Site, Dashboard, and Services regardless of whether you register an account as a I Am UNICEF User. We reserve the right to terminate your use or access to the Services at any time for any reason, including without limitation, if we learn that you have provided false or misleading information or have violated the Terms.
1.DEFINITION
“Community” is an account in the Platform managed by an Organization with whom UNICEF has a written agreement, including all its affiliate websites. A community can be a school club or an association of individuals that run their agenda and post engagement opportunities in the platform, both private engagements, and with UNICEF’s moderation and approval, engagement opportunities open to everyone.
“Community Administrator” is a Registered User with special user-rights granted to manage a Community.
“Organization” is an organization that has submitted its application to register with the Platform, whose application has been accepted by UNICEF, whose account is publicly viewable on the Platform and can submit online engagement opportunity postings.
“Registered User” is an individual who has completed the registration process anywhere on the Platform, including a Community.
“Supporter” is a Registered User who has applied for at least one engagement opportunity, and whose application has not been marked as rejected.
“User” means anyone who chooses to access this Platform, including Registered User.
2. PERMISSION TO USE THE SERVICES
Subject to the terms set forth in this Agreement, UNICEF grants you a limited, non-exclusive, non-transferable license to use the Services for your internal use and not for resale or further distribution. Your right to use the Services is limited by all terms and conditions set forth in this Agreement. Except for this permission granted to you, UNICEF and its licensors retain all right, title and interest in and to the Services, including all related intellectual property rights.
3. ACCESS TO THE SERVICES
UNICEF does not provide the equipment required to access the Services. You are responsible for all fees charged by third parties related to your access and use of the Services (e.g., charges by Internet service providers).
UNICEF reserves the right to modify or discontinue, temporarily or permanently, all or any portion of the Services without notice. UNICEF will not be liable to you or to any third party for any modification, suspension, or discontinuance of all or any portion of the Services.
4.RULES OF USAGE
This Platform may only be used in a manner that complies with all applicable laws and regulations and is consistent with these Terms of Service and Use. This Platform may contain bulletin boards, blogs, or other message or communication facilities (collectively, "Forums"). You agree to use the Forums only to send and receive messages and material that are proper and related to the particular Forum. By way of example, and not as a limitation, you agree not to do any of the following:
- Promote bigotry, discrimination, hatred or violence against any person or group.
- Threaten, harass, defame, abuse, stalk, intimidate any other person or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
- Publish, post, distribute or disseminate any incomplete, false or inaccurate material or information or any defamatory, infringing, obscene, indecent or unlawful material or information.
- Upload or attach files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or you have received all consents thereof as may be required by law.
- Upload or attach files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer, service to any User, host or network, or use any device, software or routine to interfere or attempt to interfere with the proper working of the Platform or any activity being conducted on this Platform, including, without limitation, via means of submitting a virus to any website, overloading, flooding, spamming, mail bombing or crashing.
- Delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded, or delete or revise any material posted by any other person or entity on this Platform.
- Falsify the origin or source of software or other material contained in a file that is uploaded on this Platform.
- Violate or attempt to violate the security of the Platform, including without limitation (i) accessing data not intended for such User or logging into a server or account which the User is not authorized to access, (ii) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization, or (iii) forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting.
You agree to comply with all applicable laws and regulations in your country when using this Platform.
You acknowledge that all Forums are public and not private communications. Further, you acknowledge that chats, posts, conferences, emails and other communications by other Users are not endorsed by UNICEF, and such communications will not be considered reviewed, screened, or approved by UNICEF. UNICEF reserves the absolute right to delete any material or information posted to the Platform without notice to Users.
5. SECURITY
Use of any password-protected area of the Platform is restricted to the Registered User who has registered or otherwise been given permission and a password to enter such area. The password cannot be distributed to others. The Registered User is responsible for maintaining the confidentiality of her/his information and password. The Registered User is responsible for all uses of her/his registration, if authorized by him/her. The Registered User agrees to immediately notify UNICEF of any unauthorized use of her/his registration or password.
6. PLATFORM CONTENT
UNICEF Content
UNICEF provides materials, including manuals, workbooks, guides, videos, and news to help you deepen your knowledge and understanding of issues affecting your world, and to develop and sharpen your skills. Everything on this site is for you and other Users but not for commercial use.
Except for any User- or Organization-generated content, UNICEF or its software partner 1, Inc. owns and retains all rights in and to the code, the design, functionality, and architecture of this Platform, and any software, materials or content provided through this Platform by UNICEF or its software partner 1, Inc. (collectively the “Platform IP”). Except for any rights explicitly granted under these Terms of Use, you are not granted any rights in and to any Platform IP. If you want to use Platform IP in a way that is not allowed by these Terms of Use, you must first contact the UNICEF and 1, Inc. teams for permission.
Unless we say otherwise, all the materials provided by UNICEF on this Platform are licensed under the Creative Commons Attribution-Noncommercial-No Derivatives 3.0 Unreported license. This license allows you and others to download, copy and redistribute UNICEF content on this Platform but it does not allow you or others to remix or transform or use the UNICEF content for commercial purposes. The UNICEF materials library may contain images and sounds that are trademarked by third parties. The fact that materials are included in the UNICEF materials library does not in any way limit or reduce intellectual property rights otherwise available to the materials’ owners. Nothing in these Terms of Use or the Creative Commons license will be construed to limit or reduce any party’s rights in that party’s valid trademarks. You may not use these materials to label, promote, or endorse any product or service. You are solely responsible for any violation of a third party’s intellectual property rights caused by your misuse of these materials.
The UNICEF name and logo are the exclusive property of UNICEF. They are protected under international and national laws. Unauthorized use is prohibited. They may not be copied or reproduced in any way without the prior written permission of UNICEF. Requests for permission should be sent to us at thailandao@unicef.org.
User- and Organization- generated Content
This Platform may also contain content of various Users and Organizations. UNICEF does not represent or endorse the accuracy or reliability of any content provided by any User, or any Organization or other person or entity.
You understand that UNICEF cannot control all content that is posted on this Platform. UNICEF has no obligation to screen communications or information in advance and is not responsible for screening or monitoring material posted by Users and Organization. Occasionally, content that does violate our Terms of Use may appear on this Platform. You agree that when you are exposed to content which does not conform to these Terms of Use or that you otherwise find content objectionable or offensive, you acknowledge that UNICEF is not responsible for such incidents. If notified by a User of communications which allegedly do not conform to these Terms of Use, UNICEF may investigate the allegation and determine in good faith and in its sole discretion whether to remove or request the removal of the communication. UNICEF has no liability to Users for performance or non-performance of such activities.
UNICEF reserves the right to expel Users and prevent their further access to the Platform for violating the Terms of Use or applicable law and the right to remove communications, which are abusive, illegal, or disruptive or otherwise violate these Terms of Use. UNICEF may take any action with respect to User-or Organization-submitted information that it deems necessary or appropriate in its sole discretion.
Posting Content
Posting content in Forums is great, but we want to make sure you do it respectfully! Please remember that everything that you post on this Platform is public for UNICEF’s use. If you want to keep something private, please do not post and send it to us for publication. Everything that you send to UNICEF, UNICEF can publish or send to other people.
UNICEF is trusting you as author to make sure that everything you write is accurate and appropriate. You are given the options to post opinions, comments and send messages on this Platform, nonetheless, UNICEF cannot be held accountable for mistakes that you make when posting content on this Platform. You must make sure that you are always posting things which are appropriate. If you post things that are not nice, such as personal attacks, harsh language or just things that are mean, UNICEF has the right to delete them immediately.
In posting content, you agree to provide a non-revocable right to UNICEF to use your content anywhere in a non-exclusive, royalty free manner on any platform of UNICEF’s choosing. If you choose to provide your own content to this Platform, you consent to allowing UNICEF to edit that content for clarity purposes. If you submit something with grammar or spelling problems, UNICEF reserves the right to edit those things for you. You also agree that your content may be used by UNICEF for any purpose.
7.DISCLAIMERS
You agree that you are solely responsible for any issues that you may encounter that result from your use of this Platform. Under no circumstances can UNICEF be held responsible for any damages or injuries you may have related to your use of this Platform and UNICEF’s related platforms. User agrees not to make any financial claims to other Users and/or to UNICEF.
In addition, please note that there are risks in using the Platform, and you assume all risks associated with dealing with other Users with whom you come in contact through the Platform. Because User authentication on the Internet is difficult, UNICEF cannot and does not confirm that each User is who s/he claims to be. UNICEF does not and cannot be involved in user-to-user dealings or control the behavior of Users on the Platform.
All content provided on this Platform is provided “as is”. This means that UNICEF cannot guarantee that everything you find on this Platform will be completely accurate or error-free. UNICEF preserve right to add, change, improve, or update the content on this Platform without notice. You should make sure to use content on this Platform thoughtfully and responsibly.
You agree to indemnify, hold and save harmless, and defend, at your own expense, UNICEF, its officials, employees, consultants and agents, from and against all suits, claims, demands, and liability of any nature or kind, including your costs and expenses, by any third party, including any other User or Organization, and arising out of your use of this Platform, including, without limitation, any claims alleging facts that if true would constitute a breach by you of these Terms of Use.
You will not be considered in any respect as being an employee, official, staff or agent of UNICEF.. The mention of names of specific companies or products does not imply any intention to infringe proprietary rights, nor should it be construed as an endorsement or recommendation on the part of UNICEF.
The use of designations of countries or territories does not imply a position by UNICEF on the legal status of such countries or territories, of their authorities and institutions or of the delimitation of their boundaries.
8.LINK TO OTHER SITES
This Platform may contain links and references to third-party websites. The linked sites are not under the control of UNICEF and UNICEF is not responsible for the contents of any linked site or any link contained in a linked site. UNICEF provides these links only as a convenience, and the inclusion of a link or reference does not imply endorsement of the linked site by UNICEF. If you decide to access linked third-party websites, you do so at your own risk. Also note that these other sites are subject to their own terms of use.
9.PRESERVATION OF IMMUNITIES
Nothing herein shall constitute or be a limitation upon or a waiver of the privileges and immunities of the United Nations, including UNICEF, which are specifically reserved.
10. GENERAL
UNICEF reserves its exclusive right in its sole discretion to alter, limit or discontinue the Platform or any content in any respect. UNICEF shall have no obligation to take the needs of any User into consideration in connection therewith.
UNICEF reserves the right to deny in its sole discretion any User access to this Platform or any portion thereof without notice.
No waiver by UNICEF of any provision of these Terms of Use shall be binding except as set forth in writing signed by its duly authorized representative.
